I can guarantee I have done my best to describe every physical and internal flaw that I am aware of. However, I don't claim to have gone over every inch of the car inside and out but I have tried to describe the major points as accurately as we know of at the time of the auction. Please remember that this is a used vehicle, and as with any used vehicle, it may have or develop issues or problems at any time. The vehicle is sold as-is, where-is, and with no warranty.

Please don't have unreasonable expectations that this is a new car. All information provided in this ad is based on the condition of the car at the time the ad was written.

We know of no reason why you couldn't drive it anywhere, but of course we can not make any guarantee. Please be advised that any vehicle over ten years old is exempt from mileage reporting due to age.

Please do not email with requests for the reserve. The reserve price will not change what you can afford to pay for the car. It would also not be fair to the other bidders on the car. Bid what you feel comfortable paying for the car. Any requests for reserve price will be ignored.

VEHICLE SHIPPING AND PICKUP

Vehicles must be picked up within 10 days of the close of the auction. Because we are very limited on space, cars not picked up within 10 days are subject to a $15.00 storage fee. We are available by appointment for vehicle pick up during normal weekday business hours unless you make special arrangements. Our weekends are our family time.

If you need a vehicle shipped, there are numerous shipping companies. DAS shippers has a link through Ebay motors. You can get an online quote instantly. The pick up zip code would be 94556. All shipping charges are to be paid by buyer. If you choose DAS, we can transport your vehicle to the DAS depot in Hayward for an additional $100.00. DAS will charge approximately $200.00 to pick it up at our door.

VEHICLE REGISTRATION, SALES TAX, SMOG, ETC.

We are a licensed California auto dealer. The state requires that if you are out of state and plan on coming here to pick up your vehicle, California law REQUIRES the buyer to pay sales tax and obtain a one day permit from the Department of Motor Vehicles. This is not my law but the State Board of Equalization. It can be found in Publication 52, May 2005, on the State Board of Equalization website. Here is a quote from it as it pertains to out of state buyers:

"For a purchaser to qualify for the exclusion from use tax described above, title (ownership) and possession of the vehicle or vessel must transfer tot he purchaser outside of California. When a purchaser exercises control over the vehicle or vessel in California prior to the planned out-of-state delivery, ownership transfers to the purchaser in California. Therefore, if any person other than the seller, or an agent acting on behalf of the seller, delivers the vehicle or vessel from California to the purchaser at an out-of-state location, ownership transfers to the purchaser in California, and California use tax applies. For example, if a purchaser asks a friend or hires a common carrier to deliver the property from California to himself at any out-of-state location, use tax applies."

To obtain clearance of the use tax and I quote again:

"Shipping receipts showing the date of delivery to a shipping agent and the date the property was delivered to the owner (if the vehicle or vessel was shipped). the recepts should include information that clearly describes the vehicle or vessel, such as the vehicle's identification number (VIN#) or license plate number, or the vessel's California registration number (CF#) or hull identification number (HIN#). If the recepts do not provide adequate information, you may need to provide additional documentation. Also, a vehicle purchaser may use from BOE-448, Statement of Delivery Outside California, to support the fact that the vehicle was delivered outside this sate."

If you are a California resident, we collect sales tax, registration fee, documenation fee, and a $50.00 smog inspection fee. We then provide you with registration in the window so you can legally drive the vehicle until your title and license plates arrive in the mail.

If you are an out of state buyer, you will need to pay a $55.00 documentation fee in addition to the price of the vehicle.

PAYMENT INFORMATION

Please follow the rules of the auction after it is completed regarding deposit and full payment deadlines. Anyone not following auction rules will be reported to Ebay and appropriate feedback will be left. There is a clear title on the vehicle. A non refundable $500 deposit must be sent within 24 hours of close of auction via Paypal, money order or cashier's check. Full payment needs to be received within 5 days of close of auction and must be paid via cash, cashier's check, or money order. If you reside outside the continental US you must pay via wire transfer. Please don't bid if you are unable to follow the rules.

We do not finance vehicles. You mush have your funds readily available at the end of the auction for payment. Your bid is a binding contract to purchase a vehicle.

We do not accept credit cards.

Due to an increase in Deadbeat bidders, we must insist on a nonrefundable down payment deposit within 24 hours of close of auction. Failure to leave the downpayment will result in appropriate negative feedback and I will turn the case over the Ebay Dealers Development and let them handle the situation. Simply put....don't bid unless you are prepared to follow the terms of the auction.

VEHICLE REGISTRATION

There is a clear title on the car. All vehicles that are sold to California buyers that legally require a smog inspection will include the smog unless otherwise stated in the auction. Any California buyer will be responsible for all state sales tax, license and documentation fees. Out of state buyers will need to contact their own DMV office for registration and transfer information. We will collect a $55.00 documentation fee from out of state buyers.
