AUCTION TERMS

McGonigal reserves the right to cancel all bids and end an auction early at any time, should the vehicle no longer be available for sale. Many of our auctions end early with a phone call, so don't miss out!

1. Placing a Bid: Your bid constitutes a legally binding contract to purchase this vehicle. Please do not bid if you're not seriously interested or financially able to purchase this vehicle. If deemed necessary, legal jurisdiction resides in the state of Indiana (county of Howard). Please read eBay's User Agreement prior to bidding. No rebates, discounts, or incentives will apply to this auction. There will be a $75 documentation fee that will apply in addition to the final sale price of this vehicle.

2. McGonigal reserves the right to: A.) Obtain and verify the registered information of all users who bid on this auction. B.) Cancel any and all bids at our discretion, or end the auction early if necessary. C.) Deny any suspicious bidder the privilege of purchasing any vehicle from our inventory.

3. Bidder's Qualifications: You must be 18 years of age or older and maintain a current legal US residence to bid. Bidder must also have at least one positive feedback to bid. If bidder does not have at least one positive feedback, bidder must contact seller prior to bidding. If a bidder does not have at least one positive feedback and places a bid, seller reserves the right to cancel any bids placed by this bidder.

4. Why Private Auctions?: Due to an increasing number of scams on eBay we will no longer be displaying the high bidders and bid history on our auction listings. These scams include false second chance offers, false offers to purchase the vehicle during auctions, and offers to purchase similar items to which we are selling. This is done for your safety and we apologize for any inconveniences this causes. We hope you will review our feedback and bid with confidence. 5. Special eBay Bid Retraction Rules: Please read eBay's "Retracting a Bid" a. If you place a bid before the last 12-hour period of the auction: You may retract that bid before that last 12-hour period but only for exceptional circumstances. You will not be allowed to retract that bid during the last 12-hour period of the auction. b. If you place a bid during the last 12-hour period of the auction: You will be allowed to retract the bid for exceptional circumstances but only if you do so within one hour after placing the bid. Bidder must contact seller immediately under this circumstance.

6. Trade-in Policy: We are always open to taking your current vehicle in on trade. It is always easiest and most convenient for us to see and drive your vehicle and then offer you a price to purchase your vehicle. However, we are aware that distance does not allow this to sometimes be convenient for the buyer. In this case, we still can offer a bidder a "sight unseen" appraisal range. This is a range that the buyer can expect to receive from us once we see and drive your vehicle. All of the information that you have provided us with, in regards to your vehicle, must also be true and evident with nothing hidden. If you would like a "sight unseen" appraisal, please e-mail or phone the Internet Department at 1-866-626-9440 or 765-457-6616 and provide your vehicles year, make, model, sub model, engine, VIN number, a list of value added options (CD, a/c, sunroof, alloy wheels, etc.), a detailed description concerning the cosmetic and mechanical aspects of your vehicle, and finally, digital pictures.

7. Funds & Financing: In regards to payment, we accept the following: wire transfer from your bank, certified check from your bank or lender, or cashiers checks. We do not accept personal checks. Keep in mind that we are a very large automobile dealer with access to several lenders. Most of the time, our lenders can offer you a better rate than your local bank, credit union, eBay Financing, etc. For help in arranging a pre-approved loan or for any questions regarding financing of this vehicle please e-mail or phone the Internet Department at 1-866-626-9440 or 765-457-6616 prior to bidding. 8. Buyers Inspection: McGonigal has done our best to disclose all information known about this vehicle for auction. McGonigal welcomes a buyers inspection. If you plan to have a buyers inspection, please make sure you inspect the vehicle prior to the auction ending. Inspection fees, if any, are the responsibility of the bidder. Seller is not responsible for any errors or omissions in this auction. Bidders are always welcome to an inspection during regular business hours.

9. Representations and Warranties made by seller: All new vehicles come with the full manufacturers warranty. While some vehicles may have the remainder of the factory warranty they may require transfer fees, please contact seller for further details. Many different extended service contracts may be purchased from our dealership for vehicles that qualify. Please contact seller regarding extended service contract.

10. Taxes and fees: Effective July 1st, 2004: All out of state buyers must pay sales tax in the state of Indiana if buyer drives or flies into the state of Indiana. The only exception to collection of Indiana sales tax is when seller arranges third party shipping to buyers state of residence. All successful bidders that take delivery of their vehicle in Indiana will receive a form ST-108 as proof of sales tax paid. Seller in no way makes any guarantee or statement regarding sales tax liability or method of computation in any state other than Indiana. Seller assumes no responsibilities for additional fees or taxed that may be due in bidder's home state at time of registration or plating. Due to the fact that sales tax laws vary widely from state to state, bidders are strongly urged to contact their own local Bureau of Motor Vehicles to determine how payment of out-of-state sales tax applies to their particular situation. Rebates and incentives that are applied to the vehicle could be taxed.

11. Title Information: Vehicle titles may be held by banks or lenders as collateral for loans. While we usually have all titles in our possession at closing, there are occasions where we may be waiting for them to arrive. Once the vehicle has been paid for, on average, it takes 10-15 business days before the title is mailed to the winning bidder. Buyer will receive a free 31-day temporary license tag to cover this time of paperwork transit. Certain situations may require our dealership to register and title your vehicle for you.

12. Shipping & Delivery: a. All shipping charges are buyer's responsibility. McGonigal will coordinate shipping arrangements but will not be responsible in any way for claims arising from shipping damage. b. Licensed Carriers are generally insured for $3,000,000.00. We assume no responsibility for damages incurred after the vehicle leaves our showroom. We are not affiliated with any carrier. Any claims or other communication regarding shipment of vehicles will be between you and the shipper, not with McGonigal. The amount of time it takes for delivery is dependent on the carrier, but is generally 10-15 days from the date that the vehicle is paid for until it is delivered to your destination. 13. Finalizing your Purchase: Successful high bidder MUST communicate with the Internet Department at McGonigal by phone 1-866-626-9440 or 765-457-6616 within 24 hours of the auction ending to make arrangements to complete their transaction. If we cannot confirm your intention to buy within 24 hours, we reserve the right to relist this vehicle or sell to any other qualified buyer. In order to secure winning bid on vehicle, Successful bidder (BUYER) must, within 24 hours of bid closing, contact Seller and issue a non refundable deposit in the amount of $500 via any major credit card. Within 7 days of bid closing, Buyer must send balance of funds by wire transfer, cash, bank certified funds to Seller along with a copy of their driver's license. In the case where we are shipping the vehicle (or you are unable to pick up the vehicle within the allotted 7 day period) all documents will be sent FedEx to your address. You will then sign all documents and send them back, along with payment via FedEx. Furthermore, before said vehicle is released for shipment or pickup to Buyer, all other Sale related and title related paperwork must be signed and returned complete to Seller. Federal law prohibits us from exporting new vehicles outside of the US. We reserve the right to Deny any suspicious buyer the privilege of purchasing any vehicle from our inventory.
